Flaw
We need a Constitutional Amendment to prevent the Speaker of the House from keeping the House in Recess for more than two weeks in any given year.
Article I, Section 4, Clause 2 of the Constitution reads:
The Congress shall assemble at least once in every Year, and such Meeting shall be on the first Monday in December, unless they shall by Law appoint a different Day.
Let’s wait and see what happens, but it seems to me that Speaker Johnson could convene for one day and then dismiss. If that happens it is the end of Democracy in America and also a gaping flaw in our Constitution. I suspect the authors never expected anyone to use the power to dismiss as a means to give the Executive the ability to rule like a dictator.
Sadly, we are now in an era where Constitutional Amendments are functionally impossible.
